TERMS OF SERVICE

These Terms of Service apply to website design, development, search engine optimisation (SEO), content updates, graphic design and related digital services provided by Tia Wright (ABN 81 679 845 604), trading as Tia Maria Business Design.
By purchasing a service, you agree to the following terms.
1. Services & Scope of Work
Each service includes the deliverables outlined in its product description, quote or agreed project proposal.
Any additional work outside the agreed scope, including extra pages, sections, significant content changes or additional revisions, may incur additional charges. These will be discussed and approved before work proceeds.
2. Payments & Pricing
All payments are processed securely through Stripe or an agreed alternative payment method.
Prices are displayed in Australian dollars (AUD), with GST applied as indicated at checkout.
Unless otherwise specified, services are one-off payments and do not create an ongoing maintenance contract.
Squarespace subscriptions, domain registration, third-party software and other external services are charged separately unless expressly included.
3. Project Timelines
Work begins once payment, required materials and an agreed commencement date have been confirmed.
Website in a Week services are scheduled for an approximately one-week production period, subject to the agreed scope and timely client feedback.
Delays in receiving content, approvals or access may affect the completion date. Any significant changes to the schedule will be communicated.
4. Client Responsibilities
Clients are responsible for providing accurate business information, appropriate images, content and necessary approvals.
Clients must have permission to use any supplied photographs, logos, written material or other intellectual property.
Clients are responsible for reviewing and confirming the accuracy of their business information, service claims and industry-specific requirements before publication.
5. Revisions & Additional Changes
Included revisions and support periods depend on the purchased service and will be stated in the product description or project agreement.
Requests outside the agreed scope, including new functionality, additional pages or substantial redesigns, may be quoted separately.
6. Cancellations & Refunds
If a client requests cancellation before work has commenced, any refund will be assessed against the agreed service terms and any costs already reasonably incurred.
Where work has commenced, payment for work already completed and agreed non-recoverable costs may be retained, subject to applicable law.
Any remaining amount will be assessed based on the work delivered, the agreed scope and applicable legal obligations.
If Tia Maria Business Design is unable to deliver the agreed services, an appropriate remedy or refund will be provided in accordance with applicable law.
Nothing in these terms excludes or restricts rights or remedies available under Australian Consumer Law.
7. Website Ownership & Third-Party Services
Once full payment has been received, clients receive access to and control of their completed website and ownership of original deliverables created specifically for them, to the extent those rights can legally be transferred.
Squarespace software, templates, licensed fonts, stock imagery, plugins and other third-party materials remain subject to their respective ownership and licensing conditions.
Clients are responsible for maintaining their hosting, domain registration and other ongoing third-party subscriptions unless otherwise agreed.
8. SEO, Google & AI Search
SEO and AI visibility services are designed to improve website content, technical foundations and opportunities for search visibility.
Search rankings, Google indexing, website traffic, AI search recommendations, enquiries and sales are influenced by external factors and cannot be guaranteed.
Results may take time and can vary due to competition, search engine updates and other circumstances.
9. Website Maintenance & Support
Unless specifically included in the purchased service, ongoing website maintenance, content updates and technical support are not included.
Additional support can be arranged at the applicable rate.
Clients are responsible for ongoing website management after handover unless a separate maintenance arrangement has been agreed.
10. Privacy & Confidentiality
Client information will be handled in accordance with the Tia Maria Business Design Privacy Policy.
Confidential business information and access details will only be used as reasonably necessary to deliver the agreed services, or otherwise as authorised or required by law.
11. Concerns & Disputes
If there are any concerns about a service or completed project, clients are encouraged to contact Tia Maria Business Design promptly so a reasonable resolution can be explored.
Nothing in these terms limits any legal rights or remedies that cannot lawfully be excluded.
12. Changes to These Terms
These terms may be updated from time to time. Unless otherwise agreed, the version applicable to a purchase is the version presented when that purchase was made.
